Terms of Use

Draft. These terms are being reviewed and will take effect when Solastone launches. Bracketed items are still to be filled in.

The short version: Solastone is free to use. It’s a wellness tool, not medical care and not an emergency service. What you write is yours. Please use it kindly and don’t try to break it. We work hard to make it good, but we can’t promise it’s perfect, and our liability is limited as far as the law allows.

These terms apply to the Solastone app and to solastone.co (together, “Solastone”), provided by Solastone LLC (“we”, “us”). By using Solastone you agree to them. If you don’t agree, please don’t use it.

Not medical care

Solastone is a wellness tool for noticing how you feel and trying small, well-established practices like slow breathing and grounding. It does not diagnose, treat, cure, or monitor any condition, and it is not a substitute for a doctor, therapist, or other professional. Nothing in Solastone is medical, psychological, or health advice. If you have a health concern, please talk to a qualified professional. Stop any practice that makes you feel unwell.

Not an emergency service

Solastone does not monitor what you enter and cannot respond to an emergency. Nobody is watching your check-ins. If you are in crisis or in danger, contact local emergency services, or in the US call or text 988, the Suicide & Crisis Lifeline. You can also find a helpline where you are at findahelpline.com.

Who can use Solastone

You must be at least 13 years old to use Solastone. If you are under the age of majority where you live, please use it with the permission of a parent or guardian.

Optional accounts

Solastone works fully without an account. If you choose to create one, to back up and sync your data:

How we handle your data is described in the Privacy Policy, which is part of these terms.

What you write is yours

Your check-ins, notes, thought logs, mantras, and anything else you create in Solastone belong to you. If you sign in, you give us permission to store, copy, and transmit that content only as needed to back it up, sync it to your devices, and provide the features you ask for. We don’t claim ownership of it, and that permission ends when you delete it or your account (subject to the short deletion periods described in the Privacy Policy).

Letters and mantras written by AI

Some optional features, like a letter from your stone and “Write me one” for mantras, use an AI model provided by a third party (Anthropic) to write text for you. Please keep in mind:

Acceptable use

Please don’t:

We may suspend or end access for anyone who seriously or repeatedly breaks these rules.

Our intellectual property

The Solastone app, website, name, logo, the design of the stone and its likeness in the app, and the writing and artwork in them are owned by us or our licensors and protected by law. We give you a personal, non-exclusive, non-transferable, revocable license to use the app for your own non-commercial purposes, on devices you own or control, under these terms and the rules of the app store you got it from. Practices in the toolkit draw on well-established techniques that belong to no one; our descriptions and presentation of them are ours.

The physical stone

What we share about the Solastone object shows a direction we are working toward. Designs, features (including any sensing), timing, and prices may change or not happen. Nothing on this site is an offer to sell, and joining the waitlist doesn’t reserve or commit you to anything.

Other services and links

Solastone may link to other apps, videos, and websites (for example YouTube guide videos, or other wellness apps). We don’t control them and aren’t responsible for them; their own terms and privacy policies apply.

App stores

If you got Solastone from the Apple App Store or Google Play, these terms are between you and us, not Apple or Google. Apple and Google have no obligation to provide maintenance or support for the app. If you downloaded it from the App Store, Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you, and your use must also follow the App Store’s usage rules.

Changes and availability

Solastone is young, and it will change. We may add, change, or remove features, and some may be marked as beta. We try to keep it running smoothly but can’t promise it will always be available or free of errors. Because the app keeps your data on your phone, most of it keeps working even when our servers don’t.

Disclaimers

To the fullest extent the law allows, Solastone is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don’t promise that Solastone will meet your needs, improve how you feel, or that any content, including AI-written content, is accurate.

Limitation of liability

To the fullest extent the law allows, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, health, or goodwill, arising from your use of or inability to use Solastone. Our total liability for any claim relating to Solastone is limited to the greater of the amount you paid us for it in the twelve months before the claim (for the free app, nothing) or US $50.

Some places don’t allow these limits, so some of them may not apply to you. Nothing in these terms limits liability that cannot be limited by law, or your rights as a consumer that cannot be waived.

Ending

You can stop using Solastone at any time, and delete your account in the app. We may stop providing Solastone, or your access to it, with reasonable notice where we can. If that happens, the data on your phone stays on your phone. The sections on your content, intellectual property, disclaimers, limitation of liability, and governing law continue after these terms end.

Governing law

These terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Fairfax County, Virginia, unless the law where you live gives you the right to bring it where you live.

Changes to these terms

If we change these terms, we’ll post the new version here with a new effective date, and for important changes we’ll let you know in the app or by email before they take effect. If you keep using Solastone after the changes take effect, the new terms apply.
